“OPT OUT” is NOT a win!

In my humble opinion this is NOT a WIN.  To Opt out of Smart Meters is to admit you have no right to choose or rights to your constitutional rights.

To opt out is like opting out of slavery when the slavery itself is illegal…. Don’t you see that to accept an “opt out” you have let the powers that be know you have no rights!!

This must be an “OPT IN” situation in order for the people to keep their promised rights and protection of the constitution.  I know it may seem to be a win. I assure you, the win is not for the people if we accept this… And look  at 8-9 11 & 14!(document below) Am I reading this wrong or does this make it ok for the people to pay and pay and pay for the privilege of not having a smart meter on their home when the very fact of these meters and the way they are being rolled out is a direct violation of your constitutional rights.

Let’s wake up and see this for what it is….We are being manipulated into accepting this as a win….This is a win for the Utility co Not for the people.

This is my opinion of course.  Anything less than an “Opt In” is laying down and admitting they have the right to force us and to punish us with fees and not allowing us to decide what we want attached to our homes.

Experts said it Couldn’t Be Done – Tobin Law Group & Consumers Power Alliance Score a Victory. Below is what everyone seems to be so happy about! Read carefully, you will see this is NOT a win but a way of shutting up those of us who are demanding to upholding of our US Constitutional rights.

DECISION MODIFYING DECISION 08-09-039 – Conclusions of Law – Effective Now.

1.        A residential customer should be allowed to opt-out of a wireless smart meter for any reason, or for no reason.
2.        The opt-out option adopted must balance the concerns expressed by customers against California’s overall energy policy.
3.        Allowing residential customers an opportunity to opt out of receiving a wireless smart meter should not impede ongoing state energy objectives.
4.        It is important that the selected opt-out option has the capability to allow customers to take advantage of smart grid benefits.
5.        Although a non-communicating smart meter is the preferred opt-out option, an analog meter opt-out option could be offered at this time, as there are no mandatory residential TOU rates.
6.        Customers who participate in the opt-out option should retain the meter currently installed at their location or receive the meter form (i.e., an analog meter or a non-analog, non-smart digital meter) that had been at the customer’s location prior to the installation of a wireless smart meter.
7.        Until there is additional information on the costs to offer multiple opt-out options, only a single opt-out option should be offered.
8.        Since SCE’s deployment of the Edison SmartConnect Program is consistent with the requirements of D.08-09-039, it should be allowed to recover the costs associated with offering the opt-out option to the extent those costs are found to be appropriate, reasonable and not already being recovered in rates.
9.        A residential customer selecting the opt-out option should be assessed an initial charge and a monthly charge.
10.     A discount should be provided to customers enrolled in the CARE program.
11.     There should be a second phase in this proceeding to consider cost and cost allocation issues associated with offering an opt-out option
12.     It would be appropriate to include the substantive and procedural components of D.12-02-014 in this proceeding for purposes of statewide consistency.
13.     The modifications to SCE’s Edison SmartConnect Program to include an opt-out program should be implemented as quickly as possible.
14.     An interim initial fee and monthly charge for customers electing the opt-out option should be assessed until a final decision on cost and allocation issues is issued.
15.     SCE should be authorized to establish a new two-way memorandum account to track revenues and costs associated with providing the opt-out option until a final decision on cost and allocation issues is issued.
16.     The September 21, 2011 Assigned Commissioner’s Ruling directing the utilities to allow residential customers to be placed on a delay list should no longer be applicable for SCE.

So how does this look to you? I am taken back by how many people think this is a win for the people. Know that in numbers we have the power and the might to make this right! Know that when thousands and millions of American Citizen’s stand up and say NO! not on my house, things will change. So tell your neighbors and your friends. Tell everyone you know, it is time to get involved and support and honor our Constitution. This Opt Out is a slippery road. Once a digital meter is on your home the software inside can be changed without you ever knowing it. I for one do not trust the Utility Companies, or the PUC’s, you know the ones that have assured us that “these meters do not have RF and they are not harmful or spying.”  These statements have been proven over and over to be lies.  Please learn the truth and know if we do not fight for our 4th amendment right we are all doomed to a life of slavery. Chipping is next! If we do not stop the meters we leave ourselves open to be chipped! Did you know it was actually in the first 9 versions of the health care bill? Yes, mandatory chipping for all American citizens! That is another story but mark my words, if we do not stop this now, what’s next?

I agree 100% with you. There is nothing victorious about lying down and taking with THEY ARE WILLING TO LET US DO, when they have no authority at all in this situation, other than that they take for themselves via bogus regulations and other corporate mumbo jumbo, not even remotely related to the constitution.

There is a disgusting twist that has taken place in the semantics of this whole thing. Apparently it is victorious to be charged over and over and over to NOT HAVE SOMETHING? Does this sound kind of like being forced to buy health insurance that will make the costs of health care go up and up and up? No victory there either…but this is the double speak that takes place in these situations to where people think they are winning when they are clearly losing. You’ve read 1984 right? This is how they do this to us, by working us over with night is day, good is bad, right is wrong…so that when the decisions are finally made AGAINST us, we think they are doing us a favor. All relativistic, all amoral, all slavery.  This makes me sick. PEOPLE NEED TO WAKE THE HELL UP!

Dr. Blank spoke with deep experience and commanding authority on the impact of EMFs on cells and DNA, and explained why your DNA, with its ‘coil of coils’ structure, is especially vulnerable to electromagnetic fields of all kinds. As described in the International Journal of Radiation Biology, DNA possesses the two structural characteristics of fractal antennas, electronic conduction and self-symmetry.iii

These properties contribute to greater reactivity of DNA to electromagnetic fields than other tissues, making the long-term consequences of repeated microwave exposures to our genetic material of great concern. Dr. Blank is adamant when he says that there IS evidence of harm, and that the harm can be significant. Dear (Energy Provider) and all agents, officers, employees, contractors and interested parties,

If you intend to install a “Smart Meter” or any activity monitoring device at the above address, you and all other parties are hereby denied consent for installation and use of all such devices on the above property. Installation and use of any activity monitoring device is hereby refused and prohibited. Informed consent is legally required for installation of any surveillance device and any device that will collect and transmit private and personal data to undisclosed and unauthorized parties for undisclosed and unauthorized purposes. Authorization for sharing of personal and private information may only be given by the originator and subject of that information. That authorization is hereby denied and refused with regard to the above property and all its occupants. “Smart Meters” and digital meters violate the law and cause endangerment to residents by the following factors:
1. They individually identify electrical devices inside the home and record when they are operated causing invasion of privacy.
2. They monitor household activity and occupancy in violation of rights and domestic security.
3. They transmit wireless signals which may be intercepted by unauthorized and unknown parties. Those signals can be used to monitor behavior and occupancy and they can be used by criminals to aid criminal activity against the occupants.

6. Those databases may be shared with, or fall into the hands of criminals, blackmailers, corrupt law enforcement, private hackers of wireless transmissions, power company employees, and other unidentified parties who may act against the interests of the occupants under metered surveillance.
7. “Smart Meters” are, by definition, surveillance devices which violate Federal and State wiretapping laws by recording and storing databases of private and personal activities and behaviors without the consent or knowledge of those people who are monitored.
8. It is possible for example, with analysis of certain “Smart Meter” data, for unauthorized and distant parties to determine medical conditions, sexual activities, physical locations of persons within the home, vacancy patterns and personal information and habits of the occupants.
9. Your company has not adequately disclosed the particular recording and transmission capabilities of the smart meter, or the extent of the data that will be recorded, stored and shared, or the purposes to which the data will and will not be put.
10. Electromagnetic and Radio Frequency energy contamination from smart meters exceeds allowable safe and healthful limits for domestic environments as determined by the EPA and other scientific programs.

I forbid, refuse and deny consent of any installation and use of any monitoring, eavesdropping, and surveillance devices on my property, my place of residence and my place of occupancy. That applies to and includes “Smart Meters” and activity monitoring devices of any and all kinds. Any attempt to install any such device directed at me, other occupants, my property or residence will constitute trespass, stalking, wiretapping and unlawful surveillance and endangerment of health and safety, all prohibited and punishable by law through criminal and civil complaints. All persons, government agencies and private organizations responsible for installing or operating monitoring devices directed at or recording my activities, which I have not specifically authorized in writing, will be fully liable for a fee of $100,000.00 for any violations, intrusions, harm or negative consequences caused or made possible by those devices whether those negative consequences are provided by “law” or not.

The American Academy of Environmental Medicine advised on January 12,
2012 in a letter addressed to the Public Utilities Commission of the
State of California that they opposed “the installation of wireless
smart meters in homes and schools based on a scientific assessment of
the current medical literature. Chronic exposure to wireless
radiofrequency radiation is a preventable environmental hazard that is
sufficiently well documented to warrant immediate preventative public
health action.”

“Exposure to levels of radio frequency RF (3KHz-300GHz) and extremely
low frequency ELF (300Hz) produced by smart meters warrants immediate
and complete moratorium on their use and deployment until further
study.”

The FCC guidelines that deem smart meters safe are obsolete because
they study only “thermal tissue damage and overlook genetic and
cellular effects, hormonal effects, male fertility, blood/brain
barrier damage, and increased risk of certain types of cancer from RF
and ELF levels similar to those emitted by smart meters.”

As each home becomes a “wireless telecommunications facility,”
children are particularly at risk for altered brain development,
impaired learning, and behavior.”

Current safety limits on pulsed RF are considered “not protective of
public health” by the Radiofrequency Interagency Working Group (FDA,
OSHA, EPA, FCC). Emissions of smart meters have been classified by
the World Health Organization International Agency for Research on
Cancer (IARC) as a possible human carcinogen.

The Congressional Research Service and its legislative attorneys
prepare reports for Congress on various issues. Two such reports were
issued on smart meters. “Smart Meter Data: Privacy and Cybersecurity”
was published on February 3, 2012 and “The Smart Grid and
Cybersecurity – Regulatory Policy and Issues” was published on June
15, 2011.

The writers agreed, “unforeseen consequences under federal law may
result from the installation of smart meters and the communications
technologies that accompany them.” In addition, the information
“generated from smart meters is a new frontier for police
investigations.”

The Fourth Amendment requires police to have probable cause to search
areas in which people have a reasonable expectation of privacy. Courts
deny protection to information a customer gives to a business as part
of their commercial relationship. Thus, police can access bank
records, phone, and traditional utility records through the “third
party doctrine.” Technology can erode an individual’s privacy even
more.

The American Recovery and Reinvestment Act of 2009 gave stimulus money
to electric utilities to accelerate the deployment of smart meters to
millions of homes via the Department of Energy’s Smart Grid Investment
Grant Program. Developers thought that the old patchwork
infrastructure did not interface, was an arcane system of electricity
delivery, and had to be replaced by a nationwide system called the
Smart Grid that could be easily controlled and manipulated from a
central location.

Smart meter technology is part of the Advanced Metering Infrastructure
(AMI). It records near-real time data on electricity usage, it
transmits data to the Smart Grid, and it “receives communication from
Smart Grid such as real-time energy prices, or remote commands that
can alter a consumer’s electricity usage to facilitate demand
response.”

In case you misunderstand what demand response is, here is the
official definition. “Demand response is the reduction of the
consumption of electric energy by customers in response to an increase
in the price of electricity or heavy burdens on the system.” Notice
that the reduction in consumption is not defined as voluntary when
there is a heavy burden on the system, and it incorporates the promise
by the President that our electricity prices will skyrocket.

Smart meters are designed to decrease peak demand for electricity by
turning off electricity to customers by remote. Remotely controlled
thermostats will also turn off air conditioning units.

HVAC contractors are required to install programmable thermostats on
all systems in areas where city officials have inspection authority
created by city councils. Thermostats can be overridden by the smart
meter so that a home’s temperature can also be remotely controlled.
RFID tracking tags will be gradually installed in all items purchased,
including digital thermostats. Non-digital thermostats cannot be
tracked and will thus be banned.

The Department of Energy used the $4.5 billion stimulus to reimburse
up to 50 percent of smart grid investments, including the cost to
electric utilities of buying and installing smart meters. As of
September 2011, the Federal Energy Regulatory Commission (FERC) funded
7.2 million smart meters and partially 15.5 million. The Institute for
Electric Efficiency (IEE) expects 65 million smart meters in operation
by 2015.

The issues for those who generate, seek, or use the data recorded by
smart meters are varied.

The myriad of legal entanglements cannot be predicted. According to
Richard J. Campbell, Specialist in Energy Policy, “It is unclear how
Fourth Amendment protection from unreasonable search and seizures
would apply to smart meter data, due to the lack of cases on this
issue.”

Smart meter technology measures usage as frequently as once every
minute, which appliances a consumer is using, what time of day, if a
residence is occupied, how many people reside there, if it’s occupied
by more people than usual, daily schedules, including times when they
are or away from home or asleep, if homes have alarm systems, if they
own expensive electronic equipment such as plasma TVs, if they use
certain types of medical equipment.” (Department of Energy)

Utility providers match data on electricity usage with “known
appliance load signatures” and daily schedules by observing when
residents use most electricity. U.S. v. Kyllo subpoenaed electricity
spreadsheet records because they suspected an indoor marijuana growing
operation. Imagine how much easier it would be today with smart
meters.

According to Jeffrey Carr, “Health insurance companies could determine
if a house uses certain medical devices and appliance manufacturers
could establish if a warranty has been violated.”

Smart meters collect and store data on names, service address, billing
information, networked appliances, meter IP address, transactional
records, and identity of the transmitter. Data is sent to the grid via
twisted–copper phone lines, cable lines, fiber optic cable, cellular,
satellite, microwave, WiMAX, power line carrier, and broadband over
power line. Wireless costs less but cybersecurity becomes a huge issue
because data is stored within the grid and within the physical world.

Smart meters can give police access to eating, sleeping, showering
habits, appliance use and when, TV use, and exercise equipment use
take place. Does this uphold the Fourth Amendment that the “right of
the people to be secure in their persons, houses, papers, and effects,
against unreasonable searches and seizures, shall not be violated”?

Liberties in the Constitution apply only to actions by the state and
federal governments. Utilities can be privately owned, publicly owned,
federally operated, and non-profit cooperatives. Under “public records
theory, law enforcement can request smart meter data since public
records are not afforded Fourth Amendment protection. Law enforcement
access to state public records is unrestricted.” (Slobogin, Nilson v.
Layton City)

Each state has different rules on whether utility records are public
records. For example, Florida, Georgia, South Carolina, and North
Carolina consider a person’s utility records as public records.

“Third party doctrine,” words told to another person, informant,
agent, gave police access to documents in the past such as phone,
bank, cell phone, hotel records. Utility records were treated
similarly, leaving room for smart meter records abuse.

Hackers could easily capture data from the outside with a hand-held
device, sell the information to the highest bidder, or establish
patterns in order to rob the house.

A court warrant should be required to access the data but neither the
Supreme Court nor any lower federal court has ruled on the use of
smart meters.
Perhaps people should think twice before they accept the $100 check
offered by their utility companies in order to “save the planet” and
reduce electric bills

Utilities may sell or share data obtained from smart meters with
others in order to increase revenues. Utilities are monopolies and
customers cannot switch providers in order to avoid the invasion of
privacy. Electricity is a necessary component of modern life.

“Advancement of technology threatens to erode further the
constitutional protection of privacy.” Individuals face a higher risk
that activities inside their homes will be monitored by the
government. (Congressional Research Service)

Perhaps people should think twice before they accept the $100 check
offered by their utility companies in order to “save the planet” and
reduce electric bills. Ask the Californians who have filed a
class-action lawsuit against PG&E after smart meters were installed
and their electric bills have skyrocketed. Is a small $100 bribe meant
to help you or hurt you?

What does breaking deer antlers have to do with the demise of the human race?

Please read this article slowly and see how everything effects everything.

This article may seem to address many issues. I assure you it addresses but one issue. The deliberate poisoning of mother earth and the inhabitants who dwell here.

There is something very wrong going on today on a global level. This article is not political and is not siding with any entity except one “The saving of mother earth and all who dwell here”

Who would have the power to do such horrific and undo-able damage to all life forms and indeed earth itself?

Good question. Under the disguise of being green and in an effort to slow global warming is it possible that the choices being made on this issue are literally poisoning all of us to death?

In an effort to slow global warming it appears our government and a team of scientist came up with a plan. Unbeknown to us it was discovered that particles of Aluminum, Barium, and Strontium can make a film in the sky and block harmful rays from the sun.

What kind of moron does it take to not look one step further and realize this solution will cure the problem by killing everything carbon based on the planet (you and me), including the surface of the planet itself.

There have been some alarming reports from hunters,  and reports by MD’s on this issue.  Just this past few seasons hunters have noticed that antlers, deer antlers are more brittle and weak. The trophy does not look as great with broken antlers. What is happening?  This phenomena is being studied and the results should chill you to the bone.
Scientist have found that the level of Manganese in the deer population has dropped drastically.

The cause being colder weather, the sun being blocked and plants are not able to flourish and grow to optimum strength as they have since time began here on earth.

Yes, some of the symptoms of global warming does cause colder weather, and warmer weather. It brings on more severe storms and and greater extremes in our weather. It throws off the natural cycle of the food chain on this planet and that is why so many are making such a fuss about it.
Rather than address the problem it appears our government is looking for a quick fix, one that will kill all of us.

Plants are also suffering as the PH of the soil “everywhere” is becoming too alkaline to sustain plant growth. What is happening? read on…

As you look up in the sky and see those criss cross patterns day after day that we have been seeing for years, what do you think they are? They are NOT clouds or Jet trails.
Some people call the  “chem trails”.  Lets call them what they are “ A poisonous brew of particles blown out the tail of a jet; Aluminum, Barium, Strontium” all known to be poisonous to humans and plants. So what happens when plants do not grow to maturity and the minerals locked inside that give us life do not have an opportunity to come to full strength? You got it! Less manganese, weaker bones. This is just one of what could be hundreds of effects happening.

The implications for the human race are staggering. Who would purposely poison the air, the water and the soil on a global scale?

I care! and if you stop a moment and realize the implications of this you will care as well. The minerals needed to keep the antlers of deer strong are the same minerals that keep our bones strong.  If the plants of the world are failing, then we are failing. You must know our oxygen come from the plants and as we destroy habitat we are destroying ourselves. That may seem like a separate issue and I assure you it is not.  “Everything Effects Everything”

7 – Immediately require “grounding” of all towers, wifi and sources of EMF and dirty Electricity. Did you know your kids are being radiated when they go to school? that is 8 hrs a day!!
